Permitted Seats Vs Recognized Seats. 

What is the difference between a Permitted seats Vs Recognized seats?

Every year when the medical postgraduate admission process starts this big question arises.
I have noticed that in the past years of counseling, Top rankers have opted not to take a permitted seat of the colleges and instead, they prefer taking lower branch seat. The same permitted seat was then taken by a candidate having lesser rank and after few years that permitted seat got recognized.
As per the Medical Council of India rule, any institution intending to start a new postgraduate medical education course or to increase the number of seats in the existing course shall obtain permission from the Central Government under section 10A of the act: Any new seats or additional seats added in a course in an medical college or institution are permitted seat when they start. These seats are to-be recognized after the college will fulfill Medical Counsel all norms within 4 years of being allotted.
In last 3 years nearly ten thousand new MD/MS/Diploma seats are added and as per medical counsel norms all those seats are permitted seats. Later all these seats will get recognized after fulfilling all the norms of Medical counsel of India.
So all the recognized seats present today was first a permitted seat only.
Mostly all the permitted seats in top Government colleges, Deemed universities & Private colleges get recognized. However, there are few cases in some private as well as government colleges in which the seats are yet to get recognized and are still permitted only.
The question is alive when a candidate has opted for a permitted seat & later after the completion the seat remains permitted & not be recognized in that situational what will happen?

  • If a student has completed his/her post-graduation (MD/MS course) on an MCI permitted seat but not an MCI recognized seat, can he/she have registration of additional qualification (MD/MS) in the state or any other State in which the institute is located?
  • Is the candidate is eligible for Super-specialty courses?
  • Will the candidates get a job in Government institutions?

For all the above queries, there are no clear regulations & answers from the Medical Council of India or the Board of Governors.
But there are so many references & examples where candidates have got relief from all the above-mentioned restrictions after doing post Graduation from the permitted seats.
For your references I have attached a court decisions copy in favor of such candidate whose seat was not recognized after completing their post-graduation from permitted seats. Also attaching an Article copy that has multiple references of such candidates who have decisions in their favor.
